Notice of intention to lease land

Swan Hill Rural City (Council) gives notice under Section 115(4) of the Local Government Act 2020 (Act) of its intention to grant a lease on the following terms and conditions to Field Solutions Group for the purpose of constructing, maintaining and operating a telecommunications network at Saleyards Rd, Swan Hill.

Proposed location of 30m Monopole grid power site

Principal terms of the proposed Lease:

·Term: 10 years

·Permitted Use: The purpose of constructing, maintaining and operating a telecommunications network

·Outgoings: The lessee will be responsible for maintenance, services and outgoings relating to the Premises

·Special Condition: At completion of the term the parties may agree to extend the lease for a further 10 years.

In accordance with Council’s Community Engagement Policy (Policy), any person may make a submission on this matter. All submissions must be in writing within 28 days of the date of publication of this notice and must be submitted no later than 12:00pm on Friday 20 October 2023.

If submissions are received, they will be considered at a meeting of the Council. A person making a submission is entitled to request in their submission that they wish to appear in person, or to be represented by a person specified in the submission, in support of the submission at a meeting of the Council on a date, time and place to be determined by the Council.

Any person making a written submission in accordance with the Policy is advised that all submissions and personal information in the submission will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014.

Following the consideration of any submissions, Council will decide whether to grant the lease.
