Swan Hill Rural City (Council) gives notice under Section 115(4) of the Local Government Act 2020 (Act) of its intention to grant a lease on the following terms and conditions to Indara Infrastructure Pty Ltd. (Indara) for the purpose of constructing, maintaining and operating a communications facility at Swan Hill Aerodrome, 190 Back Boga Road, Swan Hill.
Principal terms of the proposed Lease:
·Rent: $16,000 per annum plus GST
·Term: 20 years
·Permitted Use: The Lessee may use the Premises for the purpose of constructing, maintaining, and operating a communications facility.
·Outgoings: The Lessee will be responsible for maintenance, services and outgoings relating to the Premises
·Special Condition: The Tower is to be marked/painted with contrasting colour (red/white) bands.
A person may make a submission on this matter. All submissions must be in writing within 28 days of the date of publication of this notice and must be submitted no later than 12pm on Friday 2 August 2024.
All submissions will be considered in accordance with Council’s Community Engagement Policy (Policy). Submissions will be considered at a future meeting of the Council.
A person making a submission is entitled to request to appear in person, or be represented by a person acting on their behalf, in support of the submission at a meeting of the Council. To do this, a person must advise in their written submission that they wish to be heard before the Council.
Any person making a written submission in accordance with the Policy is advised that all submissions and personal information in the submission will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014.
Following the consideration of any submissions, Council will decide whether to grant the lease.
